This Privacy Policy (the "Policy") describes how HORys ("HORys", "we", "us", or "our") collects, uses, discloses, retains, and safeguards Personal Data when you interact with our Telegram bot service operating as @HORysBot (the "Service").

The Service is operated by HORys (the "Operator", the "Data Controller") in accordance with the Personal Data Protection Act B.E. 2562 (2019) of the Kingdom of Thailand (the "PDPA") and any subordinate regulations, guidelines, and notifications issued by the Personal Data Protection Committee (the "PDPC").

By using the Service, you acknowledge that you have read and understood this Policy. Where consent is the lawful basis for processing, your consent is sought separately and may be withdrawn at any time as described in Section 12.

นโยบายความเป็นส่วนตัวฉบับนี้ (“นโยบาย”) อธิบายแนวทางที่ HORys (“HORys”, “เรา”) เก็บรวบรวม ใช้ เปิดเผย เก็บรักษา และคุ้มครองข้อมูลส่วนบุคคล เมื่อท่านใช้งานบริการบอท Telegram ภายใต้ชื่อ @HORysBot (“บริการ”)

บริการนี้ดำเนินการโดย HORys (“ผู้ให้บริการ”, “ผู้ควบคุมข้อมูลส่วนบุคคล”) ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล” หรือ “PDPA”) รวมถึงประกาศและแนวปฏิบัติของคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (“กคส.”)

การใช้บริการถือว่าท่านได้อ่านและเข้าใจนโยบายฉบับนี้แล้ว ในกรณีที่ฐานทางกฎหมายในการประมวลผลคือความยินยอม เราจะขอความยินยอมจากท่านแยกต่างหาก และท่านสามารถเพิกถอนความยินยอมได้ทุกเมื่อตามที่ระบุในข้อ 12

For the purposes of this Policy, the following terms shall have the meanings set forth below:

• "Personal Data" means any information relating to an identified or identifiable natural person, in line with Section 6 of the PDPA.
• "Sensitive Personal Data" means data prescribed in Section 26 of the PDPA, including data on racial origin, religion, sexual behaviour, criminal records, health, disability, biometric data, or other data of similar nature. Birth data alone is not classified as Sensitive Personal Data.
• "Data Subject" means the natural person to whom Personal Data pertains.
• "Processing" means any operation performed on Personal Data, including collection, use, disclosure, storage, and erasure.
• "Data Processor" means a person or entity that processes Personal Data on behalf of, and under the instructions of, the Data Controller.
• "Telegram" means the messaging platform operated by Telegram FZ-LLC.
• "Anthropic" means Anthropic, PBC, the provider of the Claude large language model API.

• “เจ้าของข้อมูลส่วนบุคคล” หมายถึง บุคคลที่ข้อมูลส่วนบุคคลนั้นกล่าวถึง
• “การประมวลผล” หมายถึง การดำเนินการใด ๆ กับข้อมูลส่วนบุคคล รวมถึงการเก็บรวบรวม ใช้ เปิดเผย จัดเก็บ และลบ
• “ผู้ประมวลผลข้อมูลส่วนบุคคล” หมายถึง บุคคลหรือนิติบุคคลที่ดำเนินการประมวลผลข้อมูลส่วนบุคคลตามคำสั่งของผู้ควบคุมข้อมูลส่วนบุคคล
• “Telegram” หมายถึง แพลตฟอร์มสื่อสารที่ดำเนินการโดย Telegram FZ-LLC
• “Anthropic” หมายถึง Anthropic, PBC ผู้ให้บริการ API ของโมเดลภาษาขนาดใหญ่ Claude

3.1 Data You Provide

• Birth data: date of birth, time of birth (if provided), and place of birth (city or province), used solely for astrological computation;
• Telegram identifiers: Telegram user ID and, where publicly available, Telegram username and display name;
• Free-text inputs: questions, names, or numerical data submitted via bot menus (e.g., a name for analysis, a phone number for numerology);
• Saved preferences: bookmarks of charts, lottery searches, or named profiles, when you elect to save them.

3.2 Data Collected Automatically

• Bot interaction logs (commands, menu selections, timestamps, and computed outputs);
• Technical metadata (request timestamps, error events) for service operation and debugging;
• Token usage analytics (tokens consumed per feature, cost in THB) for cost monitoring.

3.1 ข้อมูลที่ท่านให้กับเรา

• ข้อมูลการเกิด: วันเกิด เวลาเกิด (หากระบุ) และสถานที่เกิด (จังหวัดหรือเมือง) ใช้เฉพาะเพื่อการคำนวณทางโหราศาสตร์
• ข้อมูลระบุตัวตนใน Telegram: หมายเลขผู้ใช้ (Telegram User ID) และชื่อผู้ใช้ที่ตั้งเปิดเผย (หากมี)
• ข้อมูลที่ป้อนผ่านบอท: ข้อความ คำถาม ชื่อ-นามสกุล หรือข้อมูลตัวเลขที่ท่านส่งผ่านเมนู เช่น ชื่อสำหรับวิเคราะห์ หมายเลขโทรศัพท์เพื่อตรวจเลขมงคล
• ข้อมูลที่บันทึกตามคำสั่ง: ดวงที่บันทึก หวยที่ค้นไว้ หรือโปรไฟล์ที่ท่านตั้งชื่อ

3.2 ข้อมูลที่ระบบเก็บโดยอัตโนมัติ

• บันทึกการใช้งานบอท (คำสั่ง การกดเมนู เวลาเข้าใช้ และผลลัพธ์ที่คำนวณ)
• ข้อมูลทางเทคนิค (เวลาที่เกิดข้อผิดพลาด เหตุการณ์ระบบ) เพื่อการบริหารจัดการและตรวจสอบ
• ข้อมูลการใช้ token (จำนวน token ต่อฟีเจอร์ ต้นทุนเป็นบาท) เพื่อการควบคุมค่าใช้จ่าย

We collect Personal Data from the following sources:

• Directly from you: through your interactions with @HORysBot on Telegram;
• From Telegram: limited account identifiers required for message routing, transmitted by Telegram pursuant to its own policies;
• From the Service itself: automatically generated logs and analytics arising from your use of the Service.

We do not purchase, lease, or otherwise acquire Personal Data from data brokers or third-party aggregators.

We rely on the following lawful bases under the PDPA, depending on the activity:

• Performance of contract (Section 24(3)) — to deliver the Service you have requested;
• Consent (Section 24(1)) — for processing that requires explicit opt-in, including when you elect to save personal birth records;
• Legitimate interest (Section 24(5)) — for service operation, security monitoring, fraud prevention, and aggregate analytics, where such interest is not overridden by your fundamental rights;
• Compliance with law (Section 24(6)) — to comply with applicable Thai law and lawful orders of competent authorities.

เราอาศัยฐานทางกฎหมายต่อไปนี้ตาม พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล โดยแตกต่างกันตามกิจกรรม

Personal Data is processed for the following purposes:

• To compute astrological readings, auspicious times, compatibility scores, numerology results, and lottery suggestions;
• To deliver the requested outputs to you via Telegram;
• To save your preferences and named profiles for future retrieval, where you have elected to do so;
• To monitor service performance, detect abuse, and respond to incidents;
• To produce aggregate, non-identifying analytics on Service usage and cost;
• To meet legal, regulatory, or audit requirements.

Personal Data is not used for behavioural advertising, profiling for marketing purposes, or automated decisions producing legal or similarly significant effects on you.

We engage the following Data Processors. Each is bound by contractual or platform-imposed obligations consistent with the PDPA:

Where third-party services are required for Service delivery, your continued use of the Service constitutes acknowledgment that such transmission is necessary.

Certain Data Processors are located outside the Kingdom of Thailand. Such transfers are conducted in accordance with Sections 28 and 29 of the PDPA, with appropriate safeguards including:

• Standard contractual data-processing agreements with each Processor;
• Encryption of data in transit using TLS 1.2 or later;
• Minimisation: only data strictly necessary for the stated purpose is transmitted;
• Periodic review of Processor adequacy.

You may request additional information regarding transfer mechanisms in writing using the contact details in Section 15.

The Telegram bot itself does not use cookies. The only browser-side storage used by HORys is on this legal page, where your language preference (English or Thai) is saved in your browser's local storage on your device. We do not use advertising, analytics, or tracking cookies of any kind.

The transmission of messages between you and the Service is handled by Telegram and is governed by Telegram's own privacy policy.

บอท Telegram ไม่ได้ใช้คุกกี้ การจัดเก็บข้อมูลในฝั่งเบราว์เซอร์ของ HORys มีเพียงการบันทึก ตัวเลือกภาษา (ภาษาอังกฤษหรือภาษาไทย) ของหน้านโยบายฉบับนี้ ใน local storage ของอุปกรณ์ของท่านเท่านั้น เราไม่ใช้คุกกี้เพื่อโฆษณา การวิเคราะห์ หรือการติดตามใด ๆ

Personal Data is retained only for as long as necessary for the purposes for which it was collected, in accordance with PDPA Section 37(3).

Upon expiry of the retention period or upon a valid erasure request, Personal Data is deleted or irreversibly anonymised.

We implement organisational, technical, and physical safeguards proportionate to the risk, including:

• Encryption at rest: Personal Data stored on our servers — including any saved birth profiles — is encrypted using Fernet symmetric encryption (AES-128-CBC with HMAC-SHA256 authentication);
• Encryption in transit: all communication between Telegram and our servers is conducted over TLS 1.2 or later;
• Data minimisation: we collect and process only Personal Data necessary to deliver the requested computation;
• Access control: only authorised personnel of the Operator may access systems handling Personal Data, on a need-to-know basis;
• Network: application servers are not directly exposed to the public internet; rate limiting protects against abuse;
• Access logging: all internal access to systems handling Personal Data is logged with actor, action, timestamp, and outcome.

Despite these safeguards, no system is impregnable. Should a security incident occur that is likely to result in a high risk to your rights, we will notify you and the PDPC in line with PDPA Section 37(4).

Under the PDPA, you have the following rights, subject to lawful exceptions:

• Right of access (Section 30) — to obtain confirmation of processing and a copy of your Personal Data;
• Right to rectification (Section 31) — to correct inaccurate or incomplete data;
• Right to erasure (Section 32) — to request deletion, where no overriding legal obligation applies;
• Right to data portability (Section 33) — to receive your data in a machine-readable format;
• Right to object (Section 34) — to certain processing activities, including direct marketing;
• Right to restrict processing (Section 35) — under certain circumstances;
• Right to withdraw consent (Section 19, paragraph 5) — at any time, without retroactive effect on processing already lawfully conducted;
• Right to lodge a complaint with the PDPC at https://www.pdpc.or.th.

To exercise any of these rights, please contact us using the details in Section 15. We will respond within 30 days of receipt of a verifiable request, in accordance with PDPA Section 39. We may request reasonable verification of your identity before fulfilling a request.

ตาม พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล ท่านมีสิทธิดังต่อไปนี้ ภายใต้ข้อยกเว้นตามกฎหมาย

• สิทธิในการเข้าถึง (มาตรา 30) — ขอยืนยันการประมวลผลและขอสำเนาข้อมูลของท่าน
• สิทธิในการแก้ไข (มาตรา 31) — ขอแก้ไขข้อมูลที่ไม่ถูกต้องหรือไม่ครบถ้วน
• สิทธิในการลบหรือทำลาย (มาตรา 32) — ขอลบข้อมูลในกรณีที่ไม่มีหน้าที่ทางกฎหมายที่เหนือกว่า
• สิทธิในการโอนย้ายข้อมูล (มาตรา 33) — ขอรับข้อมูลในรูปแบบที่อ่านได้ด้วยเครื่อง
• สิทธิในการคัดค้าน (มาตรา 34) — คัดค้านการประมวลผลบางประเภท รวมถึงการตลาดทางตรง
• สิทธิในการระงับการใช้ (มาตรา 35) — ในกรณีที่กฎหมายกำหนด
• สิทธิในการเพิกถอนความยินยอม (มาตรา 19 วรรคห้า) — เพิกถอนได้ทุกเมื่อ ไม่กระทบต่อการประมวลผลที่กระทำโดยชอบไปก่อนหน้า

The Service is intended for persons aged twenty (20) years or older, the age of majority under Thai civil law. We do not knowingly collect Personal Data from minors. Where Personal Data of a minor is processed (for example, when a parent or guardian consults the Service for their child's birth chart), the requesting adult is responsible for ensuring proper authority and consent. Should we become aware that a minor has provided Personal Data without lawful authority, we will delete it without undue delay.
